Disclaimer of warranty

There is no warranty for the Software, to the extent permitted by applicable law. Except when otherwise stated in writing, the Company, Maintainers, and/or other parties provide the Software “AS IS” without warranty of any kind, either expressed or implied. This includes, but is not limited to, the implied warranties of merchantability and fitness for a particular purpose. The entire risk regarding the quality and performance of the Software rests with you. Should the Software prove defective, you assume the cost of all necessary servicing, repair, or correction.

Limitation of liability

In no event – unless required by applicable law or agreed to in writing – will any Maintainers, copyright holders (such as the Company), or any other party who modifies and/or conveys the Software as permitted above be liable to you for damages. This includes any general, special, incidental, or consequential damages arising from the use of or inability to use the Software. Such damages encompass, but are not limited to, loss of data, data inaccuracies, losses sustained by you or third parties, or the Software’s failure to operate with other software — even if the liable party was advised of the possibility of these damages.

We reserve the right to update Terms of Use from time to time. Significant changes will be announced on our Website, GitHub, or social media channels. Continued use of Helium or the Services after changes take effect constitutes acceptance of the revised Terms.
